Question re: ANC 8C quorum and election
*5 commissioners of ANC 8C so if at least 3 members at the properly noticed meeting are PRESENT then there is a quorum. One or two can abstain but as long as three members are present then there was a quorum. This is very important because it was pointed out that in the January meeting there was an election that was held to elect the officer positions. Commissioners Jordan, Shelton and Ellis were present for that meeting. Commissioners Jordan and Shelton voted with Ellis abstaining to vote. Therefore according to the quorum rules this election was valid. Commissioner Jordan would be Chair and Commissioner Shelton would be Vice Chair.
49:25 Commissioner Cuthbert speaks and begins her excuses, accusations and falsehoods and creates a distraction. Singles out residents of Savoy Court. Accuses Commissioner Jordan of not living in SMD 8C02 (a blatant lie).

52:54 Sandra Seegars asks for clarification on notice for “emergency meetings or lack of notice for “good cause”. Gottlieb Simon says that it is strongly advised that ANCs provide AT LEAST 7 days of written notice to the community regarding ANC Monthly Meeting.
· How much is the yearly allotment for ANC 8C? How much money is in the bank account? Yearly Allotment for ANC 8C is $21, 015 – quarterly allotments (if reports are approved and filed) are $5,053.80. Per the DC Auditor as of Dec 2008 (because the March report still had not been filed) $33, 480.95 is in the ANC bank account. DC Auditor cautions ANC 8C that if the quarterly report is not in soon the account is in danger of being frozen.

· If an ANC is not submitting their reports on time or meetings are not being held properly. Who addresses that problem to making sure they are resolved? If 3 reports are not filed on time the account is frozen.
Deborah Nichols practice as DC Auditor – after an ANC fails to file 2 reports late she subpoenas the bank to get the statements to see how the money is being spent. If there is any questionable expenditure then she will refer the matter to the inspector general and will freeze the account.
1:0:00 things get out of hand and D Nichols threatened to leave and scolded the group for not working together. Stated that historically that the problem with ANC 8C is that they do not work together and let petty differences divide the ANC.
More community questions are posed including concerns from the community regarding the continued “payment” of ANC funds for the “office”. Many residents express concern over the 100k payments. During this time Commissioner Cuthbert gets pretty irate.

Quorum Requirements
In order have a quorum have to be more than half of the commissioners at the meeting and more than have of the seats also have to be filled.
Example:
7 commissioner seats in total for ANC 8C. At least 4 commissioner seats must be filled in order to have an ACTIVE ANC.
Per Gottlieb Simon in order to have a quorum you have to have more than half of the seated commissioners in attendance to have a quorum. For ANC 8C to have a quorum at least 3 commissioners have to be PRESENT at a PROPERLY NOTICED MEETING. All the commissioners do not have to vote but they have to be PRESENT.
Quarterly Reports and Allotments
If quarterly reports are not filed by the end of the fiscal year the quarterly allotment is forfeited (lose). Quarterly reports
Proper Notice Requiring Meetings
ANC Meetings have to be scheduled with at least 7 days public written notice for a meeting. If two types of the 4 types of notice are not given with at least 7 days notice (unless it is a documented emergency meeting) then that meeting is invalid and any decision or motion voted on in that meeting it not valid and is void.
Bonding and Security Fund
Chairperson and Treasurer must be bonded UNLESS the ANC participates in the security bond with the treasurer otherwise they can not issue any expenditure for the ANC. The bond and the security fund protect the ANC in the event of mismanagement or theft of ANC funds (the bond and security fund do not protect the ANC against funds that are issued contrary to auditor rules and requirements)
DC Auditor discussed the efforts to have ANC Chairpersons and Treasures positions required to be free of serious criminal offenses such as embezzlement, theft, forgery, etc.
